1.) A Return Material Authorization (RMA) must be obtained from R-Cubed on all repairs by R-Cubed.
2.) R-Cubed warrants for a period of 90 days from the date of repair, that each repair performed by R-Cubed be free of defects in workmanship. Manufacturer of such part covers any parts used in repair. During this period, if the customer experiences difficulties with a repair performed by R-Cubed and are unable to resolve the problem with R-Cubed Technical support, an RMA will be issued. Following receipt of RMA, customer is responsible for returning the product to R-Cubed (freight prepaid by customer). R-Cubed, upon verification of warranty will, at its option, repair or replace the product and return to customer (freight prepaid by R-Cubed). The customer’s sole and exclusive remedy in the event of a defect is expressly limited to repair or replacement at the discretion of R-Cubed. R-Cubed has the right to use new or reconditioned parts in all repairs. If R-Cubed repairs or replaces a product, its warranty term is not extended.
3.) It is the sole responsibility of the customer to verify that the products perform to customer’s expectations during the warranty period.
4.) On-Site services are not included as a part of these warranties.
5.) All software and operating systems sold by R-Cubed are warranted by the manufacturer or developer of such software.
6.) General Terms – The above warranties shall not apply to expendable components such as toner cartridges, ribbons, burned-in screen image on tubes etc… and any other items not part of the basic product repaired by R-Cubed. R-Cubed shall have no obligation to make repairs or to cause replacement required by normal wear and tear or necessitated in whole or part by catastrophe, acts of God, fault which it was not designed, or causes external to the product, such as, but not limited to, power failure or environmental problems. R-Cubed’s sole obligation hereunder shall be to repair or replace items covered in the above warranties. Customer shall provide for removal of the defective product, shipping charges for return to R-Cubed, and installation of it’s replacement. Above warranties are subject to change without notice.
7.) If product(s) returned under provisions of this warranty are subsequently determined by R-Cubed to be functionally operational and in accordance with product specifications, i.e., “NO FAULT FOUND” (NFF), then customer will be charged a minimum bench fee and the product will be returned to customer freight collect.
8.) Warranty claims must be received by R-Cubed within the applicable warranty period. A replaced product, or part thereof, shall become the property of R-Cubed and shall be returned to R-Cubed at customer’s expense. All returned material must be accompanied by an RMA.
9.) THE EXPRESS WARRANTIES SET FOURTH IN THIS AGREEMENT ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ALL SUCH OTHER WARRANTIES ARE HEREBY DISCLAIMED AND EXCLUDED BY R-CUBED. THE STANDARD EXPRESS WARRANTIES ARE IN LIEU OF ALL OBLIGATIONS AND LIABILITIES ON PART OF R-CUBED FOR DAMAGES, INCLUDING BUT NOT LIMITED TO SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE PRODUCTS.
10.) SPECIAL NOTICE TO CUSTOMERS – SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. THE WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
